THE INFORMATION WE COLLECT

We obtain information about you when you use our Services. Certain information is necessary for us to provide the Services. If you do not provide it, or ask us to delete it, you may no longer be able to use all or part of our Services.

Information You Provide to Us. We collect information directly from you through account registration and administration; questions, communications, or feedback you submit by email, online form, or live chat; your participation in research and surveys; and requests for customer support. This may include your name, mailing address, telephone number, and email address; billing information such as payment card, bank account, and routing numbers and identity-verification information collected through our payment processors on our behalf; log-in credentials; information about your purchases and transactions; information about your customer-service interactions with us; content you post in public areas of our Services; and any other information you choose to provide.

Information We Collect Through Automated Means. We and our service providers use technologies to collect information about your use of the Services and the devices you use to access them. This includes domain names, browser type, operating system, browser plug-ins, cookie preferences, search terms, the pages you view, time spent on pages, and similar usage information. We also collect general location information (such as IP address and the city, state, or postal code associated with it) to enable location-based content and accurate sales-tax calculation. Certain analytics and product-improvement tools we use, including Microsoft Clarity, may record session activity such as page interactions, clicks, and scrolling in order to help us understand and improve the Website. Sensitive fields are masked where supported.

Information From Social Media. When you interact with us on social media platforms, or sign up for a promotion through one of our social accounts, we may collect your name, email address, and any content you post that is relevant to Dayspring Pens.

COOKIES, TRACKING TECHNOLOGIES, AND YOUR CONSENT

We and our service providers use cookies, pixels, web beacons, software development kits, and similar technologies to operate the Website, remember your preferences, measure performance, and (with your consent) deliver and measure advertising. Strictly necessary technologies are required for the Website to function. Non-essential technologies, including analytics, session recording, and advertising tools, are deployed based on the consent choices you make through the cookie banner and preference controls on our Website.

You can manage your preferences at any time through the cookie settings link on our Website, and you can disable cookies through your browser, although the Website may not function properly without them. Where you have enabled a recognized universal opt-out signal such as Global Privacy Control (GPC), we treat it as a request to opt out of the sale or sharing of personal information and of targeted advertising for that browser or device, as described under Your Privacy Rights below.

HOW WE USE YOUR INFORMATION

General Use. We use your information to operate and manage the Services, including verifying and administering your account, processing payments, fulfilling orders, communicating with you about your orders and inquiries, presenting content effectively, enabling interactive features, and keeping the Services safe and secure.

Service Improvement. We conduct research to understand and improve the effectiveness of our Services. Results we publish are presented in de-identified, aggregate form.

Promotional Communications. We may contact you about your orders and the Services. We will send marketing communications by email or text only where you have opted in to receive them, and marketing consent is never a condition of any purchase. You can unsubscribe from marketing email at any time using the unsubscribe link in any message, or opt out of marketing text messages as described below. You may still receive transactional messages about your orders even if you opt out of marketing.

Analytics. We use your information to understand interests and needs, measure the effectiveness of our content and advertising, and, with your consent, deliver relevant advertising.

Combined and De-Identified Information. We may combine information we collect with information from other sources and use it consistent with this Privacy Policy. We may aggregate or de-identify information so it can no longer be linked to you, and may use and share such information for any lawful purpose.

SMS AND TEXT MESSAGING

We do not currently operate an SMS marketing program. If we offer one in the future and you provide your mobile number and separately opt in, we may send you recurring text messages related to your order, customer service, or, where you have specifically consented, marketing. Consent to receive text messages is never a condition of purchase. Message frequency varies, and message and data rates may apply. You can opt out at any time by replying STOP, and reply HELP for help. We do not sell, rent, share, or transfer your mobile phone number or your SMS consent to any third party or affiliate for their own marketing purposes. Your mobile information is shared only with the vendors that operate our messaging program and only to deliver the messages you requested.

DATA ANALYTICS AND ADVERTISING

Analytics. We use third-party analytics services, including Google Analytics and Microsoft Clarity, to understand how visitors use the Website, measure performance, and improve our Services. Google Analytics features, including Google Signals, may collect engagement information across the devices you use to access the Services where you have enabled personalized advertising in your Google account. You can install the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout.

Advertising. With your consent, the Services use advertising technologies from partners such as Google and Meta, and our email and messaging platform Klaviyo, that use cookies and similar technologies to deliver and measure advertising on the Services and on other sites and apps you use. We may also provide certain customer information, such as hashed email addresses, to advertising partners who match it to deliver more relevant ads. Under certain state privacy laws, this kind of targeted advertising may be treated as a "sale" or "sharing" of personal information, and you can opt out as described under Your Privacy Rights and through the cookie controls on our Website.

You can also learn about industry opt-out tools through the Network Advertising Initiative (opt-out link) and the Digital Advertising Alliance (opt-out link). We do not control these tools or whether a given company participates. If you opt out, you will still see advertising, but it will not be tailored to you based on your activity over time.

LIVE CHAT AND COMMUNICATIONS

We offer live chat and customer-support messaging through a third-party provider, Gorgias, and we may use other communication tools. When you contact us through chat, email, web form, or phone, your communications may be monitored, recorded, and stored, and they are processed by our service providers on our behalf, in order to respond to you, provide support, train our team, and improve our Services. By using these channels, you consent to this monitoring, recording, and processing. Please do not submit sensitive information such as full payment card numbers through live chat.

HOW WE SHARE YOUR INFORMATION

Service Providers. We share information with service providers who perform services for us, including payment processing, fulfillment and shipping, billing, marketing and advertising, analytics, customer service, data storage, IT and security, fraud prevention, and legal and auditing services. They are permitted to use the information only to provide services to us.

Advertising Partners. As described above and subject to your consent and opt-out choices, we may share certain information with advertising partners to deliver and measure advertising.

Legal Compliance and Protection. We may access, retain, and disclose information when reasonably necessary to comply with law, a subpoena, or court order, to enforce our Terms of Service or this Privacy Policy, or to protect our rights, users, or the public.

Business Transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be among the assets transferred.

Public Forums. Information you post publicly, such as a product review, is not confidential and may be displayed on our Websites and elsewhere along with any name you provide. Please take care when using these features.

De-Identified Information. We may create and share de-identified information that can no longer be linked to you.

We do not sell your personal information for money. Some sharing for targeted advertising may qualify as a "sale" or "sharing" under state law, and you can opt out as described below.

YOUR PRIVACY RIGHTS

We extend the following rights to all United States residents, regardless of the state in which you live. Subject to verification and legal exceptions, you have the right to: confirm whether we process your personal information and access it; correct inaccurate personal information; request deletion of your personal information; obtain a portable copy of your personal information; opt out of the sale or sharing of your personal information and of targeted advertising; opt out of certain profiling; limit the use of sensitive personal information; and not be discriminated against for exercising these rights.

How to exercise your rights. Submit a request by emailing support@dayspringpens.com or by using the contact information below. We may need to verify your identity before fulfilling your request, and an authorized agent may submit a request on your behalf with proof of authorization. For opt-out of sale, sharing, and targeted advertising, you may also use the cookie controls on our Website or a recognized universal opt-out signal such as Global Privacy Control, which we honor for the relevant browser or device.

Appeals. If we decline your request, you may appeal by replying to our decision or emailing support@dayspringpens.com with "Privacy Appeal" in the subject line. We will respond within the time required by applicable law. If your appeal is denied, you may contact your state attorney general.

California sensitive information. We do not use or disclose sensitive personal information for purposes that require offering a right to limit under California law beyond providing our Services and as otherwise permitted.

FINANCIAL INCENTIVES

From time to time we may offer a discount or other benefit in exchange for signing up for our email or text marketing, which involves collecting your contact information. Participation is optional, you may withdraw at any time by unsubscribing, and any difference in price or service is reasonably related to the value of the information you provide. Details of any current offer are presented at the point of sign-up.

DATA RETENTION

We retain personal information for as long as needed to provide the Services, maintain your account, comply with our legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we delete or de-identify it.

DATA SECURITY

We implement reasonable and appropriate security measures consistent with prevailing industry standards to protect personal information from unauthorized access. No method of transmission or storage is 100% secure, however, and we cannot guarantee the absolute security of information you transmit to or store with us.

THIRD-PARTY LINKS AND CONTENT

Our Website and emails may contain links to third-party websites. We are not responsible for the privacy practices or content of those websites. Links are provided for convenience and do not imply endorsement.

SUBMITTING INFORMATION FROM OUTSIDE THE UNITED STATES

We control and operate the Services from within the United States, and the Website is directed only to users in the United States. We do not target the European Economic Area, the United Kingdom, or other jurisdictions abroad. Information collected through the Services may be stored and processed in the United States. If you access the Services from outside the United States, you do so on your own initiative. The English-language version of this Privacy Policy is the controlling version.

CHILDREN'S PRIVACY

Our Website and Services are intended for users over the age of 18 and are not directed to children. Consistent with the Children's Online Privacy Protection Act, we do not knowingly collect personal information from anyone under the age of 13, and we do not intend to collect it from anyone under 18. If we learn that we have collected personal information from someone under 18, we will delete it. We encourage parents and guardians to talk with their children about online safety.

CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. The information we collect is subject to the Privacy Policy in effect at the time of collection. We will indicate the effective date at the top of this Privacy Policy and, where appropriate or required, provide additional notice of material changes.
